Terms of Use for ratings.tp3.de

1. Scope

These Terms of Use govern the use of the ratings.tp3.de platform and the associated services provided by R&P IT Consulting GmbH, hereinafter referred to as the “Operator.”

By using the platform, the user agrees to these Terms of Use.

2. Description of Services

ratings.tp3 enables the collection, processing, analysis, preparation, and publication of customer reviews and review-related information on its own and affiliated platforms.

The Operator may import, process, and consolidate reviews and associated metadata from various sources and make them available to search engines, AI systems, and other digital channels.

The scope of functionality may be expanded, restricted, or modified at any time.

3. Costs and Fees

Use of the platform is generally free of charge at the time of registration.

The operator reserves the right to offer individual features or the entire platform for a fee in the future.

Users will be informed in a timely manner of any new fees. Paid use is permitted only with the user’s express consent or upon the conclusion of a corresponding contract.

4. Rights to Imported and Provided Content

The user warrants that they are authorized to use the content they have provided, imported, or linked to, and to grant the operator the necessary rights thereto.

The user grants R&P IT Consulting GmbH a non-exclusive right of use, unlimited in terms of territory and duration, to the reviews, comments, texts, images, metadata, and other content provided, to the extent necessary for the operation of the platform.

This right of use includes, in particular:

• the storage and processing of the content,
• the analysis and evaluation of the content,
• preparation for search engines and AI systems,
• publication on ratings.gpt3 and affiliated platforms,
• making the content available via interfaces (APIs),
• the use of the content for search, ranking, analysis, and recommendation functions.

The user retains ownership of their original rights to the content provided.

5. Publication of Reviews

The user agrees that imported or provided reviews may be published on ratings.tp3.de, ratings.tp3, and other platforms operated by the operator or affiliated platforms.

In doing so, content may be technically processed, categorized, shortened, structured, or tagged with additional metadata, provided that the original meaning is not distorted.

6. Responsibility for Content

The respective user is solely responsible for the legality of the content provided.

The operator is not obligated to review submitted content prior to publication but reserves the right to remove content or refuse to publish it at any time.

7. Availability

The operator strives to ensure the highest possible availability of the platform. However, there is no guarantee of a specific level of availability.

Maintenance work, technical malfunctions, or further development may lead to temporary restrictions.

8. Termination and Deletion

The user may terminate their use of the platform at any time.

The operator may suspend or delete user accounts in the event of violations of these Terms of Use or for good cause.

Content that has already been published may continue to be stored even after termination of use for technical, legal, or documentary reasons, to the extent required by law or legitimate interests.

9. Liability

The operator bears unlimited liability in cases of willful misconduct and gross negligence, as well as for damages resulting from injury to life, limb, or health.

In all other cases, liability is limited to foreseeable damages typical for this type of contract.

10. Changes to the Terms of Use

The operator may amend these Terms of Use at any time, to the extent necessary for legal, technical, or economic reasons.

11. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

To the extent permitted by law, the place of jurisdiction is Wiesbaden.
